حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، وَعَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ قُسَيْطٍ اللَّيْثِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ
أَنَّهُ قَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ أَيُّمَا امْرَأَةٍ طُلِّقَتْ فَحَاضَتْ حَيْضَةً أَوْ حَيْضَتَيْنِ ثُمَّ رَفَعَتْهَا حَيْضَتُهَا فَإِنَّهَا تَنْتَظِرُ تِسْعَةَ أَشْهُرٍ فَإِنْ بَانَ بِهَا حَمْلٌ فَذَلِكَ وَإِلاَّ اعْتَدَّتْ بَعْدَ التِّسْعَةِ الأَشْهُرِ ثَلَاثَةَ أَشْهُرٍ ثُمَّ حَلَّتْ
“What is done among us when a slave divorces a slave- girl when she is a slave and then she is set free, is that her idda is the idda of a slave-girl, and her being set free does not change her idda whether or not he can still return to her. Her idda is not altered.”
Malik added, “The hadd-punishment which a slave incurs is the same as this. When he is freed after he has incurred but before the punishment has been executed, his hadd is the hadd of the slave.”
Malik said, “When a free man divorces a slave-girl three times, her idda is two periods. When a slave divorces a free woman twice, her idda is three periods.” Malik said about a man who had a slave-girl as a wife, and he bought her and set her free, “Her idda is the idda of a slave-girl, i.e. two periods, as long as he has not had intercourse with her.
If he has had intercourse with her after buying her and before he set her free, she only has to wait until one period has passed. ‘ Yahya related to me from Malik from Yahya ibn Said and from Yazid ibn Abdullah ibn Qusayt al-Laythi that Said ibn al-Musayyab said, ‘Umar ibn al-Khattab said, ‘If a woman is divorced and has one or two periods and then stops menstruating, she must wait nine months.
If it is clear that she is pregnant, that is that. If not, she must do an idda of three months after the nine, and then she is free to marry.’’’”
রেওয়ায়ত ৭০. উমর ইবন খাত্তাব (রাঃ) বলিয়াছেনঃ যেই স্ত্রীকে তালাক দেওয়া হইয়াছে তারপর হায়য (মাসিক ঋতু) আসিয়াছে এক হায়য বা দুই হায়য, অতঃপর তাহার ঋতুস্রাব বন্ধ হইয়া গিয়াছে, সেই স্ত্রী নয় মাস যাবত অপেক্ষা করিবে (ইতিমধ্যে) গৰ্ভ প্রকাশ পাইলে, তবে সন্তান প্রসব দ্বারারা ইদ্দত পালন করিবে, নতুরা নয় মাসের পর তিন মাস ইদ্দত পালন করিবে, তারপর সে অন্যের জন্য হালাল হইবে।
মালিক (রহঃ) হইতে বর্ণিত, সাঈদ ইবন মুসায়্যিব (রহঃ) বলতেন, পুরুষের জন্য হইল তালাকের অধিকার আর স্ত্রীদের জন্য হইল ইদ্দত।
سعید بن مسیب سے روایت ہے کہ حضرت عمر بن خطاب نے فرمایا کہ جس عورت کو طلاق ہو پھر ایک یا دو حیض کے بعد اس کا حیض بند ہو جائے تو وہ نو مہینے تک انتظار کرے گی اگر حمل معلوم ہو تو بہتر ہے ورنہ پھر تین مہینے عدت کر کے دوسرا نکاح کرے ۔
Telah menceritakan kepadaku Yahya dari Malik dari [Yahya bin Sa'id] dan dari [Yazid bin Abdullah bin Qusaith Al Laitsi] dari [Sa'id Ibnul Musayyab] ia berkata, [Umar Ibnul Khattab] berkata; "Wanita mana saja yang dicerai kemudian dia mengalami sekali atau dua kali haid dan setelah itu dia monopause (tidak lagi haid), maka hendaklah dia menunggu sampai sembilan bulan.
Jika dia dalam keadaan hamil maka ia menjadi halal setelah melahirkan, tetapi jika tidak hamil maka ia harus menjalani masa iddah lagi selama tiga bulan. Setelah itu dia boleh menikah
Ömer b. el-Hattab der ki: «Boşanıp bir ya da iki hayız gördükten sonra hayız (adet) görmemeye başlayan bir kadın, dokuz ay bekler, hamile olduğu anlaşılırsa iddeti, çocuğu doğurunca biter. Hamile değilse, dokuz ayı müteakip üç ay daha bekler, sonra iddeti bitmiş olur, başka biriyle evlenebilir.»
