وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ
أَنَّهُ قَالَ: قَالَ عُمَرُ بْنُ الْخَطَّابِ لَا تُنْكَحُ الْمَرْأَةُ إِلاَّ بِإِذْنِ وَلِيِّهَا أَوْ ذِي الرَّأْىِ مِنْ أَهْلِهَا أَوِ السُّلْطَانِ
He had heard that Said ibn al-Musayyab had said that Umar ibn al-Khattab said, “A woman is only married with the consent of her guardian, someone of her family with sound judgement or the Sultan.”
রেওয়ায়ত ৫. মালিক (রহঃ)-এর নিকট রেওয়ায়ত পৌছিয়াছে যে, সাঈদ ইবন মুসায়্যাব (রহঃ) বলিয়াছেন, উমর ইবন খাত্তাব (রাঃ) বলিয়াছেনঃ অভিভাবক বা উক্ত পরিবারের বুদ্ধিমান ব্যক্তি অথবা রাষ্ট্রপ্রধানের অনুমতি ব্যতীত কোন মহিলাকে যেন বিবাহ দেওয়া না হয় না।
